Although Apple developed a workaround to bypass the import ban, Masimo is now suing U.S. Customs for allowing new Apple Watches to enter the country.
Apple, meanwhile, is asking an appeals court to overturn the ban completely.
Apple previously countersued Masimo and won only $250, the statutory minimum, for a design patent violation.
The legal fight continues as both sides escalate their claims.
