NFT brand Pudgy Penguins says it plans to fight a trademark lawsuit filed by PEI Licensing, the company behind Original Penguin apparel. The dispute centers on penguin-themed branding used on clothing, which PEI claims infringes on its historic trademarks tied to the fashion label.

According to Pudgy Penguins’ chief legal officer Jennifer McGlone, the company was surprised by the lawsuit, noting both sides had been in discussions to resolve the issue privately. She said the project already has several trademark approvals from the United States Patent and Trademark Office and believes the designs target entirely different audiences. The brand also responded publicly with a meme on social platform X, joking that the two penguin brands look nothing alike.
