Polymarket is taking a stand.
The prediction market filed a federal lawsuit against Massachusetts, arguing that the CFTC has exclusive authority over event contracts — and states can’t shut down federally regulated markets on their own.
Neal Kumar, Polymarket’s chief legal officer, called state enforcement “an amazing opportunity missed” to help build markets for tomorrow.” The move follows recent court actions in Massachusetts and Nevada, which barred Polymarket and Kalshi from offering sports-related contracts.
With prediction markets reaching $3.7B in weekly trading volume, Polymarket is arguing that federal law should take precedence over fragmented state regulations — a battle that could reshape how prediction markets operate nationwide.
