The US government has formally opposed the inclusion of an amicus brief from the DeFi Education Fund as a federal court weighs whether to retry two brothers accused of orchestrating a $25 million exploit on Ethereum. Prosecutors argue the brief adds nothing new and merely repeats legal arguments the court has already rejected.
The case, overseen by Judge Jessica Clarke, remains in limbo after a mistrial was declared in November due to a deadlocked jury. Federal prosecutors are now pushing to move forward with a retrial as early as February 2026, signaling the government’s intent to keep pressure on what it sees as a landmark crypto enforcement case.
