Beyond the sports betting debate, prediction markets are facing a separate and arguably more serious problem: they are becoming a tool for insider trading on real-world events. Illinois Governor JB Pritzker and New York Governor Kathy Hochul both signed executive orders this week prohibiting state employees from using privileged information to participate in prediction markets. Pritzker was blunt in his reasoning, warning that prediction markets allow people to bet on events they can directly influence, opening the door to abuse of confidential information on a scale that existing oversight frameworks were never designed to address.

The concern is backed by real cases. An anonymous trader pocketed over $400,000 by placing large bets on US military action in Venezuela just hours before the government announced it had kidnapped Venezuelan President Nicolas Maduro. In France, police are investigating alleged tampering with weather forecasting equipment at Charles de Gaulle airport that coincided with suspicious Polymarket bets. In Israel, an air force reservist has been charged with leaking classified military data through a Polymarket bet, allegedly earning $244,000 by wagering on the precise timing of an Israeli air strike on Iran — details he knew in advance through his military role. Taken together, these cases paint a picture of a market structure that is increasingly being exploited by those with access to non-public information.
